Terms and conditions

1. Accommodation agreement

This Agreement is signed between the Guest and Dai.Kon srl in relation to the Accommodation indicated in detail in the reservation form and contains the terms and conditions applicable to the contractual relationship between the Guest and Dai.Kon srl in relation to the use of the Accommodation. Dai.kon srl grants the Guest the short term use of the Property for the period agreed and indicated in the Reservation Form. The Guest has no exclusive ownership in relation to the Accommodation. The acceptance of the reservation is subject to the availability of the chosen accommodation and the payment of the agreed price. The Price includes rent and incidental expenses. Final cleaning costs are quantified under an independent item but form part of the “Price”.

 

2. Reservations

The Reservation of the Accommodation can be made on our website either as “Immediate Reservation” or as “Availability Request”. Immediate reservation – once you have entered your arrival and departure dates and the exact number of people, you shall immediately receive confirmation of availability and of the Price along with any various offers that may be available at the time. If the Accommodation is available, you can proceed immediately with the Reservation. Availability request – after sending an availability and information request on our website, you shall receive an e-mail reply. Once you have received this written confirmation, you can proceed with the Reservation. The Accommodation shall be considered reserved for the entire duration of the Accommodation Period only after the Reservation Confirmation is sent to the Guest and, therefore, Dai.kon srl shall be required to make the Accommodation available – and the agreement can be considered concluded – only when the Reservation Confirmation is sent by e-mail to the Guest. After sending the Reservation Confirmation or in case of immediate reservation, the Guest shall have to pay the full amount for the stay in the Accommodation due to Dai.Kon srl.

 

3. Cancellations

Unless otherwise indicated in the Reservation Form, the following cancellation policy shall apply. NON REFUNDABLE RESERVATION. The booking cannot be changed if the Guest opted for to pay the “non-refundable” option at the cheaper rate. In this case the booking cannot be changed and the Guest is liable for the full amount if the reservation is cancelled or changed at any time after the same or if the Guest fails to be present at the agreed upon check-in time. FLEXIBLE BOOKING. If the Guest has opted for a flexible booking, the Guest can cancel their booking free of charge up to seven days in advance of their arrival. In this case, the Guest will be entitled to receive a full refund of the price. In case of cancellation of a reservation within 7 days of their arrival or in case that the guest fails to be presnt at check-in, the Guest must in every case pay 100% of the total amount due for the rental of the Accommodation as indicated in the Confirmation of the Reservation (“Price for Accommodation”) for the entire duration of the Period of Stay (and the Guest authorizes Dai.Kon srl to withhold this amount from the credit and debit card whose details have been indicated by the Guest during the booking phase) with the exception being the tourist tax, which is not liable. Dai.Kon srl cannot cancel the reservation once the relating confirmation has been sent. Each Accommodation Agreement constitutes a contract entitling you to occupy a specific accommodation in a given period of time. Any change in relation to the dates of stay or to the accommodation may result in the cancellation of the reservation, unless otherwise agreed. Should Dai.kon srl be forced to cancel the Reservation of an Accommodation, this shall be communicated as soon as possible; in this case Dai.kon srl shall be entitled to offer an Accommodation as an alternative to the one reserved. If this is not possible, or the Accommodation proposed alternatively is not to the liking of the Guest, Dai.kon srl shall return the full Price. No other amount can be claimed and no further claim for damages, liquidated damages, indemnity can be requested to Dai.kon srl greater than the simple reimbursement of the amount collected as a rent for the accommodation. It should be noted that the provisions concerning the right of withdrawal with regard to distance contracts concluded pursuant to Article 59 of the Consumer Code do not apply.

 

4. Fees and services

The Guest agrees to pay the full Price for the Accommodation indicated in the Reservation Form as well as the incidental expenses and to reimburse the cost of any damage caused to the Accommodation or its furniture and to pay the Fees in relation to the stay beyond the permitted terms. The total price for the Accommodation indicated in the Reservation Form is related to the enjoyment of the Accommodation and includes only the services indicated in the Reservation Form. Dai.kon srl offers two types of accommodation prices: one called “flexible booking” and one called “non-refundable bookng” according to the restrictions on the possibility of cancellations or refunds. By accepting these terms and conditions the Guest undertakes to pay the full Price for the Accommodation and authorizes Dai.kon srl to collect all the amounts indicated in the Reservation Form. Should the Guest disregard the reservation or check-in, the terms set out for cancellations shall apply (and the Guest hereby authorizes Dai.kon srl to retain such amounts from the credit and debit card whose details have been indicated by the same in the reservation).

 

5. Arrivals and departures.

The Guest may occupy the Accommodation between 3.00 p.m. and 8.00 p.m. on the day of arrival; he/she must leave it before 10.00 a.m. on the day of departure. The Guest can enjoy an evening access time between 8.00 p.m. and 11.50 p.m. In this case he/she hereby undertakes to carry out the identification procedure, mandatory by law, by 12.00 noon the following day by telephone appointment with Dai.Kon srl. Should the Guest not be available within this time, he/she shall be deprived of access to the premises and the procedure provided for failure to vacate the accommodation as described in the next paragraph shall apply. The time for check-out is indicated in the Reservation Form. Should the Guest stay in the Accommodation for more than 2 (two) hours longer than the agreed check-out time Dai.kon srl shall have the right to access the Accommodation, remove the Guest’s personal belongings, change the lock of the Accommodation and take any further necessary action charging the Guest the costs of each action. The Guest must pay an additional fee of Euro 250,00 per day (or part of it) for each period of unauthorized stay.

 

6. Number of people

When filling in the Reservation Form, the Guest must provide the data of all the people who will stay in the chosen Accommodation, during the whole period or part of it. The maximum number of people who will stay in the Accommodation cannot exceed the number stated in the Booking Form of the Accommodation itself.

 

7. Security deposit

At the beginning of the Guest’s stay at the Accommodation, the Guest shall pre-authorize Dai.kon srl to keep a sum as a security deposit payable by a credit or debit card (which could also be different from the one indicated in the booking) and Dai.kon srl shall have the right to make deductions from such credit or debit card in case of damage to the Accommodation or its furniture or in the case of a late check-out or a stay beyond the permitted time limits also with reference to the quantification of predeterminable damages form which the Guest states to have read. The Guest must communicate as soon as possible any case of loss, theft or damage to the Accommodation and its equipment, its appliances or installations, or its contents during the stay and even if the Guest should consider the damage caused by normal wear and tear or should not consider himself/herself to be responsible for the damage. The Guest must report to Dai.kon srl any defects in the property and furniture or missing items as compared to the inventory within 24 hours from the delivery of the keys. Lacking a report, the above mentioned missing items or defects shall be presumed to be attributable to the tenant. Any deductions made as a result of damage caused to the property shall be charged to the credit or debit card that the Guest has provided and/or on which a charge has been pre-authorized as a security deposit, but it is understood that the Guest shall be fully responsible for any damage caused by the Guest, his/her family members or third parties placed in the property and not only within the limits of the amounts pre-authorized as security deposit. If the value of the loss, theft or damage exceeds that of the Security Deposit, the Guest shall be required to pay the excess within 30 days of receipt of a written communication from us (by e-mail). In case, during the stay, the Guest loses all the keys of the Accommodation, or does not give them back on departure, Dai.Kon srl shall be authorized to keep the amount of EUR 10 from the Security Deposit and we shall replace them as soon as possible.

8. The Apartments

Dai.kon srl has the right to modify the furniture and equipment of the Accommodation without notice. Despite the undertaking to promptly update the presentation of the Accommodation on the website, Dai.kon srl is not responsible for differences which are not of the essence between illustrations, texts or photos on the website and the actual status of the apartments. It is forbidden to sublet and loan, in whole or in part, the apartments. Our apartments are private residences and not tourist facilities. They cannot therefore be classified according to international standards.

 

9. Safety and rules of conduct during the Accommodation

The Guest shall be fully responsible for his/her personal safety during his/her stay at the Accommodation. The Guest shall have to see the list of the equipment left at the accommodation, of every instruction and prescription regarding fire prevention, health and safety that will be given to him/her and shall have to listen to the instructions or explanations that will be given by the staff of Dai.kon srl at the check-in when he/she will be shown the accommodation. Should the Guest become aware of any event during the stay that he or she believes may represent a risk to his or her health and/or safety, he or she must immediately inform Dai.kon srl. The Guest shall have to comply with the condominium rules, the Accommodation Rules and every instruction from Dai.kon srl. The Accommodation Rules are published online or handed in to the Guest upon check-in. The Guest shall not be allowed to let persons other than those indicated in the Reservation Form or any additional guest indicated in the Reservation Form occupy the Accommodation. This Agreement is personal in nature and may not be transferred to third parties. During the Accommodation Period, Dai.kon srl shall not be able to authorise access to the Accommodation to any other person than those indicated in the Reservation Form. The Accommodation information specifies the maximum number of guests allowed to stay in the Accommodation. Should the Guest allow more people to stay in the Accommodation than the maximum number allowed, this Agreement may be immediately terminated. The Guest also agrees: To sign, at the time of check-in, a short lease agreement for the rented property; to keep the leased property; not to smoke at the accommodation; to keep the Accommodation clean, tidy and free of garbage and leave it in the same condition in which it was delivered; to not keep or take pets or other animals in the Accommodation (unless otherwise agreed with Dai.kon srl and with specific indication in the Reservation Form that they are pet-friendly); not to take any action which may or could result in a breach of any authorisation in relation to the Accommodation or which may be in total or partial breach of any insurance taken out from time to time in relation to the Accommodation; not to obstruct or leave objects or waste in common parts, if the Accommodation is part of a building or complex with common parts; not to leave any personal property outside of the Accommodation; not to move the furniture from its original position and/or room inside the Accommodation; not to engage in or permit conduct in the Accommodation that is likely to result in harassment, damage (whether or not punishable), disturbance, obstruction or inconvenience to Dai.kon srl or to the landlords or occupants of the building or to any other owner or neighbour, including but not limited to playing loud music or playing musical instruments, dancing, engaging in leisure activities in the Accommodation or moving furniture; not to engage in illegal or questionable behaviour within the Accommodation; not to carry out within the Accommodation business or activities of a commercial nature of any kind; not to make any alterations or additions of any kind to the Accommodation or its furniture; not to use the Accommodation for purposes other than personal accommodation; not to invade the privacy of Dai.kon srl and not to publish or disclose anything that may allow third parties to identify the address of the property (even if such information is already in the public domain). The Guest acknowledges that the Accommodation is a dwelling and that it is forbidden to open any closet, drawer or room that is not freely accessible or sealed with tamper-proof tape and agrees to pay a fixed fee as provided in the Accommodation Rules for any tampering with the tape. By this agreement the Guest agrees to indemnify Dai.kon srl in relation to any costs, claims, liabilities or expenses suffered or incurred by Dai.kon srl in relation to any violation of this clause.

 

10. Dai.kon srl’s Liability

Dai.kon srl shall not be liable to the Guest for any economic, financial and/or indirect damage such as loss of reputation, loss of chance, loss of profit, loss of advanced sums or loss of opportunity arising from this Agreement, the Accommodation or the stay (even if such loss is attributable to Dai.Kon srl). The liability of Dai.Kon srl for all losses (except personal injury resulting from gross negligence) shall be limited to the greater of (i) the costs necessary to obtain the replacement of the Accommodation in relation to the agreed Accommodation Period and (ii) the amount of the Fee for the Accommodation and related expenses. No further amounts shall therefore be due to the Guest. If, in the course of the rental, the property needs repairs that cannot be postponed until the end of the agreement, the Guest must tolerate them even if they may result in deprivation of enjoyment of part of the rented property. If during the course of the rental period it is declared that all or part of the premises are incapable or unfit for the contractual use, Dai.kon srl shall be required exclusively to refund the rent in proportion to the days on which the property was uninhabitable. The payment of any other sum by way of indemnity, compensation for direct and/or indirect damages resulting from the loss of use of the property is excluded. The afore-mentioned provisions do not exclude the liability of Dai.kon srl for personal injury arising out of or resulting from gross negligence on the part of its agents or employees.

 

11. Remarks/ Complaints

Every reasonable care shall be taken to ensure that the Accommodation is presented to the Guest to a high standard. In case the Guest on arrival finds a problem or a reason for complaint it shall be necessary to contact immediately Dai.Kon srl’s representative. Dai.Kon srl undertakes to ensure that any complaints from the Guest during the stay are resolved in an efficient and timely manner. Failure to give timely notice of the complaint or refusal of reasonable rectification may prejudice the Guest’s right to compensation. The Guest must not independently move to another accommodation without having allowed Dai.kon srl to provide assistance in the resolution of a complaint. Otherwise, or in the event of a reasonable refusal to rectify, this circumstance could affect the Guest’s right to compensation. The Guest shall formally confirm any unresolved complaint in writing by e-mail to Dai.kon srl within 28 days from the end of the Guest’s Accommodation Period.

 

12. General Provisions

The Guest states to have the legal capacity to sign this Agreement. The Guest shall not be able to retain the amounts due from him/her in favour of Dai.kon by way of right of retention, set-off with the amounts due to him/her. Dai.kon srl cannot be held liable vis à vis the Guest or in default with regard to these terms and conditions on grounds of any delay in performance, or omission in relation to its obligations, if the delay or default is due to circumstances beyond its control, such as bad weather, power outage or other utilities, wilful misconduct or gross negligence on the part of other tenants, co-owners or third parties, or for damage as a result of flooding, breakage, partial collapse, dampness, burglary, natural disasters, strikes, government action, terrorism, war and civil unrest, or other cause. Except in the case of fraud, these terms and conditions represent the entire agreement between the parties and supersede all prior marketing information, representations or agreements made in writing or otherwise. The parties agree that these terms and conditions are fair and reasonable given the circumstances. However, if any provision of these terms and conditions is held by a competent court to be invalid without prejudice to its validity following deletion of part of it, such provision shall be deemed applicable with any deletion deemed necessary to make it valid. Should any provision of these terms and conditions be held invalid, the remaining provisions of these terms and conditions shall remain in full force and effect.

 

13. Applicable law and jurisdiction

This Agreement is subject to Italian Law and the jurisdiction of the Italian Courts. Any dispute arising out of, or in connection with, this Agreement shall be submitted exclusively to the competent Court. Date Sign
